So wait:
Is one of Antonin Scalia’s arguments agains the Affordable Care Act REALLY that it is too long?  I get, completely, that the supreme court has a LOT on its plate, and that they need to move with deliberate speed through each issue that comes to them, and that because of the sheer volume of their work they need to turn away far more cases than they actually can see, but IF one of your cases...
